Privacy Notice (KVKK)

This privacy notice is provided under Article 10 of the Turkish Law No. 6698 on the Protection of Personal Data ("KVKK") to inform visitors of the Eminoğlu Law Firm website, and people who contact us through the contact form, about how their personal data is processed. In case of any discrepancy, the Turkish version prevails.

1. Data controller

Your personal data is processed by Atty. Süleyman Eminoğlu (Eminoğlu Law Firm) as data controller.

2. Personal data processed

If you fill in the contact form, the following data is processed:

  • Identity and contact details: full name, email address and (optionally) phone number,
  • Message content: the information you choose to share in the form,
  • Security data: IP address and browser information technically logged by the hosting provider when you access the website.

Please do not share special categories of personal data (such as health information or criminal records) in your message; you may discuss such matters directly with your lawyer at the first meeting.

3. Purposes of processing

  • To assess your enquiries and requests for a meeting and to respond to you,
  • To conduct preliminary discussions towards establishing a lawyer–client relationship,
  • To keep the website secure and prevent misuse,
  • To comply with legal obligations.

4. Method of collection and legal grounds

Your personal data is collected electronically through the contact form on the website, as submitted by you.

Your data is processed on the legal grounds set out in Article 5(2) of the KVKK: processing being directly related to the conclusion or performance of a contract (c), compliance with the data controller's legal obligations (ç), and the data controller's legitimate interests, provided that your fundamental rights and freedoms are not harmed (f).

5. Transfer of personal data

Limited to the purposes above and to the extent needed to provide the service technically, your personal data may be transferred to the following service providers:

  • The contact form delivery provider (Web3Forms),
  • The email service provider (Microsoft 365),
  • The website hosting and security provider (Cloudflare).

As the servers of these providers are located outside Turkey, your data may be transferred abroad. Such transfers are carried out in accordance with the conditions set out in Article 9 of the KVKK. Otherwise, your data is only disclosed to public authorities legally entitled to request it, upon request and to the extent permitted by law.

6. Retention period

Your personal data is kept for as long as required for the purposes of processing and for the retention periods set by applicable legislation, after which it is deleted, destroyed or anonymised. If a lawyer–client relationship is established, retention obligations under professional legislation also apply.

7. Cookies and third-party content

Our website does not use cookies for advertising, analytics or tracking. The map on the contact page is provided by Google Maps; when the map loads, Google may process certain technical data under its own privacy policy.

8. Your rights under the KVKK

Under Article 11 of the KVKK, you have the right to apply to the data controller to:

  • Learn whether your personal data is processed,
  • Request information about the processing,
  • Learn the purpose of processing and whether data is used for that purpose,
  • Know the third parties in Turkey or abroad to whom your data is transferred,
  • Request correction of incomplete or inaccurate data,
  • Request deletion or destruction of your data under the conditions of Article 7 of the KVKK,
  • Request that third parties to whom data was transferred be notified of such correction, deletion or destruction,
  • Object to a result against you arising from analysis of your data exclusively through automated systems,
  • Claim compensation for damages arising from unlawful processing.

9. How to apply

You can submit requests regarding your rights in writing, including information that identifies you, to Atatürk Mah., Ataşehir Blv. Ata 2/3 Plaza No: 6 Kat: 6 Daire: 55, 34758 Ataşehir / İstanbul, or by email to info@eminogluhukuk.com, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller.

Your request will be concluded free of charge as soon as possible and within thirty days at the latest. If the process requires an additional cost, a fee may be charged according to the tariff set by the Personal Data Protection Board.
